    What changed and why it matters.

    Section 21 is abolished from 1 May 2026. That means every possession case now requires you to prove a Section 8 ground in tribunal. The most common one landlords reach for is Ground 8, which covers rent arrears. Under the Renters' Rights Act 2025, the threshold has increased. You now need 3 months of arrears at both the date you serve notice and the date of the court hearing, up from 2 months. If your tenant pays down just enough before the hearing, your mandatory ground is gone.

    There is also a new Ground 8A, which applies where a tenant has been at least 2 months in arrears on 3 separate occasions within 3 years, even if they are currently under the threshold. It is designed exactly for tenants who repeatedly fall behind then catch up to avoid eviction. Most landlords have not heard of it. Most software does not track it.

    Before you can serve any Section 8 notice, courts will reject your claim if your deposit is not correctly protected. This applies to all tenancies, including ones that started years ago, and it applies even on mandatory grounds. One missing piece of paperwork can void a valid eviction claim and cost you months of lost rent while you start the process over.
